On March 10, (AIDESEP) the Asociaci\u00f3n Inter\u00e9tnica de Desarrollo de la Selva Peruana presented, via email, a Submission to the Secretariat for Submissions on Environmental Enforcement Matters of the USA-Peru Trade Promotion Agreement (TPA) (also known as the USA-Peru FTA), invoking the lack of effective application of the Forest and Wildlife Law, Law No. 29763 and the Regulation for Forest and Wildlife Management in Native Communities and Peasant Communities related to the regulation of the granting of forest concessions in Indigenous Reserves.<\/p>\n
The Indigenous Reserves, according to the Law for the protection of indigenous or native peoples in isolation and in situation of initial contact, Law No.28736 (PIACI Law), are lands delimited by the Peruvian State, of transitory intangibility, in favor of indigenous peoples in a situation of isolation or in situation of initial contact, to protect their rights, their habitat and the conditions that ensure their existence and integrity as peoples. This Law, in turn, protects the Indigenous Reserves pending approval.<\/p>\n
The Submitters indicated that, despite the fact that forest and wildlife legislation has established that inside either approved Indigenous Reserves and those in process cannot be granted forest concessions, the Regional Government of Loreto has granted 47 forest concessions located in the Yavar\u00ed Tapiche Indigenous Reserve and in the Yavar\u00ed Mirim Indigenous Reserve in process.<\/p>\n
After acknowledging receipt of this Submission, the Secretariat is evaluating compliance with its admissibility requirements, in accordance with the provisions of the Peru-USA Trade Promotion Agreement.<\/p>\n
IIt should be noted that the Secretariat for Submissions on Environmental Enforcement Matters is in charge of handling these Submissions that are presented by the public, in accordance with the provisions of the USA-Peru Trade Promotion; which constitutes a citizen participation mechanism agreed between both countries to promote the effective application of environmental legislation in each of them.<\/p>\n
